Same-Sex Divorce Laws in Texas

The U.S. Supreme Court’s June 26, 2015 decision in Obergefell v. Hodges required states to recognize lawful same-sex marriages. Since that ruling, same-sex spouses in Texas have been able to marry and divorce under the same general legal framework as opposite-sex couples. Under Texas Family Code § 6.001, Texas permits a no-fault divorce when the marriage has become insupportable because of discord or conflict of personalities that destroys the legitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation.

Texas Family Code Chapter 6 governs the dissolution process.
